THIS LIFETIME LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE. THE LIMITED WARRANTY CAN ALSO BE FOUND ONLINE AT www.homewoodcreations.com/warranty.
We warrant that during the Warranty Period, the Product will be free from defects in materials and workmanship.
We limit the duration and remedies of all implied warranties, including without limitation the warranties of merchantability and fitness for a particular purpose to the duration of this express limited warranty.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Our responsibility for defective goods is limited to repair or replacement as described below in this warranty statement.
Who may use this warranty?
Homewood Creations (“we”) extends this limited warranty only to the consumer who originally purchased the Product (“you”). It does not extend to any subsequent owner or other transferee of the Product.
What does this warranty cover?
This limited warranty covers defects in materials and workmanship of the cabinets, finish, and hardware (the “Product”) for the Warranty Period as defined below.
What does this warranty not cover?
This limited warranty does not cover any damage due to:
- Transportation
- Storage
- Improper use
- Failure to follow the Product instructions or to perform any preventive maintenance
- Modifications
- Unauthorized repair
- Normal wear and tear, including but not limited to scratches, dents, other types of abrasion, wear on the lacquer or finish, etc.
- Damage caused by dealer
- Abuse
- Harsh chemicals
- Natural disasters
- Installers or other contractors / third parties
- Dropped parts
- Sun bleach
- Outdoor use or exposure
- Fire or flood
- Water damage
- External causes such as accidents, abuse, or other actions or events beyond our reasonable control
If the Product is installed prior to the home or building being painted in which the Product is installed, the warranty is void. This is due to the fact that the Product can be damaged from overspray and damage from the painters.
The limited warranty is limited to the original purchaser of the Product. It does not cover Product that has been transferred to a new owner. The limited warranty also only covers Product installed in its original location. The limited warranty does not cover Product that has been moved from where it was originally located, even if it is in the same home or building.
We will not provide a warranty if you and/or your dealer made a mistake in your order. We build the Product according to the specifications and layout provided to us by your dealer. The limited warranty does apply to Product that was built correctly according to your specifications if your specifications were incorrect. We do not design Product or submit orders on your behalf. We only manufacture the Product. You must submit orders through your dealer. The limited warranty is void if you have us submit the order for the Product.
What is the period of coverage?
This limited warranty begins when the Product is picked up from our warehouse or when the Product is delivered to you and the packing slip is signed and continues for the lifetime of the Product (the “Warranty Period”).
What are your remedies under this warranty?
With respect to any defective Product during the Warranty Period that is covered by this limited warranty, we will repair or replace such Product (or the defective part) free of charge within one (1) year of your claim. There are no refunds. All sales are final. We will pay for a third party to repair the Product if we are unable to repair it.
How do you obtain warranty service?
To obtain warranty service, you must call the dealer representative during the Warranty Period and provide proof of purchase with a receipt or invoice. We will work with your dealer to replace or repair the defective Product. We reserve the right to inspect the Product prior to providing the warranty service. Replaced or repaired Product may be mis-matched with color due to aging.
Limitation of liability
THE REMEDIES DESCRIBED HEREIN ARE YOUR SOLE AND EXCLUSIVE REMEDIES FOR DEFECTIVE PRODUCT AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
